TERMS & CONDITIONS

The online store of the www.own.pt website shall be governed under the terms and conditions here defined. OWN may, at any time, change it totally or partially.

The prices in the catalogue of the www.own.pt website are in euros and include vat at the legal rate in force at the time of acquisition, to which the delivery cost must be added, when applicable. The prices and product specifications contained in this site may be changed by OWN, without prior notice and at any time.


ORDERS

OWN takes orders from almost all over the Europe, however the shipping costs vary by country/region. To make any order in www.own.pt website is not necessary to be registered.

After payment, please send us the bank transfer receipt to the email info@own.pt, specifying the order number at the subject.

Soon as the payment is confirmed by OWN, the order is shipped in 1-3 (one to three) business days, depending on the object. Then the customer is notified via email, where is given a tracking number that will allow the Client to follow the path of his order.

The products shown in the online catalogue are limited to existing stock. In case any item is unavailable, OWN will inform the Client. For some products, duly identified, the order may be limited to a certain number of copies.


DELIVERY

All orders confirmed by OWN will be delivered to the address specified by the Customer for the delivering the order. The shipping costs are calculated at purchase. *2

The delivery is done by Registered Mail, so the Customer can, at any time, follow the order’s route through a tracking number that will be provided by OWN after its expedition.

In case we run out of stock, the customer will be contacted by email about the new expected delivery date and the Costumer can decide whether to maintain or cancel the order.

PAYMENT

We have 2 payment options available: 1- Direct Bank Transfer. This should be done when your order is ready for expedition. At this time, you will get an email from us notifying you of that. This email will include your invoice and payment details. As soon as we get proof of payment, we proceed with dispatching the goods. Depending on the volume of your order and your customization requirements, these conditions might change and you will be notified of that by email. 2 – Payment via Paypal. If you happen to choose this option, you will notice the charging of Paypal’s service fee, and will be redirected to Paypal’s website to proceed with payment. You will then receive an email from one of us confirming your order. All prices are inclusive of VAT and are subject to shipping charges.

CANCELLING THE ORDER

The customer may cancel the order, provided that it has not yet been processed by OWN. The cancellation of the order may be formalized by an email sent to the address info@own.pt and the Customer must mention the order number and his tax identification number, under penalty of ineffectiveness of the cancellation.

REFUSAL OF THE ORDER

OWN reserves the right to refuse the order, in which case it will inform the Customer, given the following cases: out of stock, unavailability of the item or if OWN considers that there has been misconduct by the buyer or inaccuracies in the personal data recorded.

RETURNS

All products shipped by OWN are carefully analysed to ensure its good condition in the shipping time. However, if the Client detects any problem or imperfection, should formalize the request for return through the email info@own.pt, within 14 (fourteen) consecutive days after receiving the product. The Client shall expressly indicate the reasons for his complaint and always mention the order number and his tax identification number.

The support team of the www.own.pt website will coordinate with the Customer how to proceed with the return of the goods, if justifiable, in which case OWN will assume the costs of the return and of a new shipment.

In situations where the reasons for the return are not attributable to OWN, the return will be accepted, within 14 (fourteen) consecutive days after receiving the product. After checking if the pieces returned and their packaging are in good condition, it will be refunded only the amount corresponding to the product, paid by the customer at purchase, being excluded the shipping transportation costs, whether they have been assumed by OWN or by the Costumer. The return shipping costs will be assumed by the Client.

OWN reserves the right to not accept returns of products without prior notice, as mentioned above, and which do not meet the same conditions of conformity as they did on the date of their delivery to the Buyer (namely products that have undergone any use, transformation, damage and/or are missing the original packaging/accessories/extras).

WILL I RECEIVE THE SAME PRODUCT THAT I SEE IN THE PHOTO?

Yes, except in the case of products which are hand crafted in which there may be slight differences in the final product.

LIMITATION OF THE LIABILITY

We make every effort to ensure that the information presented is free of typographical errors and whenever they occur, we proceed with their correction as soon as possible. In case the information provided does not match the characteristics of the product, the Customer has the right to return according to the terms specified in the topic “Returns”.

The photographs presented on the site are merely illustrative. We recommend that you consult the product characteristics for detailed information.

Despite the efforts of OWN, some products may have an incorrect price, therefore we also check the prices when processing orders. If the price of the product is less than the advertised price, we will refund the difference. If the price is higher, we will inform the customer by email and await his decision as to whether or not he accepts the new price or if he wishes to cancel the order.

REGISTRATION AND PROTECTION OF PERSONAL DATA

When registering to use OWN website, we will ask the Customer to create a password. The Customer should keep it strictly confidential, not revealing nor sharing it with third parties. The Customer is entirely and exclusively responsible for the use of his password and any orders placed by using it, even without his knowledge.

In the case of registered Customers, we will collect the information required to carry out the whole sales transaction online and for future contacts that may be necessary so as to ensure the best customer service.

The Customer assures that the personal data provided are true and accurate and undertakes to notify any changes. Any loss or damage caused to the online store or a third party resulting from incorrect inaccurate or incomplete information on the registration forms will be the sole responsibility of the Customer.

The services provided by OWN will always honour the provisions of the Personal Data Protection Law – Law no. 67/98 of October 26th, therefore, the sole purpose of OWN regarding the Customer’s personal data is the Customer’s account management, billing, communication with Customers, statistical analysis and direct marketing, assuming the commitment to privacy and security in the processing of personal data of each Customer.

The Customer authorizes OWN to send information on products and services that may be of interest, using their personal data for direct marketing. At any time, you may request access, correction and deletion of data, using the following email: info@own.pt

INTELLECTUAL AND INDUSTRIAL PROPERTY

Any reproduction or representation, whether total or partial, of the www.own.pt website or of the elements included in it is strictly forbidden.
Trade names, trademarks or distinctive symbols reproduced in the www.own.pt website are protected under the laws applicable to industrial property. The reproduction or representation of all or part of any distinctive symbol is strictly forbidden.

COOKIES

In order to provide our users with greater speed and customization of the service rendered, OWN may use a feature of the “browser”, called a “cookie”. A “cookie” is a small text file, automatically saved by the user’s computer, which allows his/her identification whenever the user visits again, in this case, the OWN website.

Any user can, however, configure his browser in order to prevent the installation of “cookies” in his computer. However, this option can make browsing slower, as in other sites.

APPLICABLE LAW AND JURISDICTION

These Terms and Conditions for online shopping in the www.own.pt website are governed by Portuguese legislation.

The parties agree that any dispute arising from the interpretation and/or application of these Terms and Conditions, whose amicable settlement is not reached, will be submitted exclusively to the jurisdiction of the courts of the headquarters of the OWN, with express waiver to any other.

By using the online store, the Customer accepts and agrees with these Terms and Conditions and the Privacy Policy and Personal Data Protection.
